Shipping policy
Delivery is made by truck or by post to the Customer's domicile or to the Customer's construction site. The transport cost share is shown separately on the order confirmation. Delivery includes unloading (parking area / valley station), but without carrying the goods into the premises. If assembly/installation has been agreed, one journey to the site is included in the transport price. Each additional journey is charged separately. Disposal of the pallet/packaging is the Customer's responsibility and is at the Customer's own expense.
The indication of delivery dates by SkyPergola is non-binding. SkyPergola endeavours to meet the delivery dates but does not guarantee them. Any claims for damages or withdrawal due to the non-observance of delivery dates are rejected. At the Customer's request, and provided that this request was communicated by the Customer to SkyPergola at the time the contract was concluded, the goods can be collected at the business branch of Planzer in Regensdorf. The specific collection location is communicated to the Customer upon request. Even in the case of collection by the Customer, SkyPergola does not guarantee any dates and rejects claims for damages due to delays in the collection option available to the Customer.
In the case of delivery by SkyPergola, SkyPergola is entitled to make partial deliveries. A delivery date can only be met if the Customer fulfils their obligations and the information required for delivery and, where applicable, assembly/installation reaches SkyPergola at the agreed time, or, if no time has been agreed, at least 14 working days in advance. In the event of late arrival, SkyPergola is no longer bound to an agreed delivery date. If there is no agreement regarding a delivery date, SkyPergola delivers as soon as the goods are available. If the Customer is in default of acceptance or breaches their duties to cooperate, SkyPergola is entitled to assert any damage arising therefrom.
If the assembly/installation requires special (structural or organisational) measures such as, for example, the use of a crane or the opening of building components, SkyPergola must be informed at the conclusion of the contract. SkyPergola is entitled, but not obliged, to carry out or arrange the relevant measures itself or through third parties. Any costs arising therefrom are charged directly to the Customer. SkyPergola reserves the right not to become a contracting party directly with respect to such services, but to commission this work from third parties in the name of the Customer. In any case, the Customer must ensure that a flawless assembly/installation by SkyPergola or a contractual partner or an auxiliary person of SkyPergola is possible. In particular, the Customer must ensure that the ground and any necessary electricity and water supply lines exist properly and in compliance with all of SkyPergola's specifications, and that a professional and, where applicable, licensed electrician is present at the acceptance. A functional water hose led to the device for filling the whirlpool/swim spa is likewise a prerequisite. If the delivered product is not to be / cannot be put into operation at the same time as delivery, any additional expenses (e.g. due to a renewed outward and return journey) are invoiced separately. The responsibility for the existence of permits (from the municipality, neighbours, landlord, etc.) lies entirely with the Customer. SkyPergola assumes no liability whatsoever in this regard, and the absence of a permit or similar also has no effect on the existence of the contract between SkyPergola and the Customer.
